Please read these Terms and Conditions carefully before using the MyFlat platform. These terms govern your use of our services and form a binding legal agreement between you and MyFlat.

1. Acceptance of Terms

By accessing or using MyFlat ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to all terms, you may not use the Service. These Terms apply to all users, including Company Admins, Building Managers, and Residents.

2. Description of Service

MyFlat provides a cloud-based property management platform enabling companies to manage buildings, residents, events, news, services, complaints, and related communications. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, your organisation must submit a company request and receive approval. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.

4. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) upload harmful, offensive, or infringing content; (c) attempt to gain unauthorised access to any part of the Service; (d) use automated tools to scrape or extract data without permission; (e) impersonate any person or entity.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein. You are responsible for ensuring you have appropriate legal bases for processing personal data of your residents within the platform.

6. Subscription and Billing

Paid plans are billed on a monthly or annual basis. Fees are non-refundable except as required by law. We may change pricing with 30 days' notice. Failure to pay may result in suspension of your account. Enterprise plans are governed by a separate agreement.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by MyFlat and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload to the Service.

8. Limitation of Liability

To the maximum extent permitted by law, MyFlat shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate the agreement at any time with 30 days' written notice. MyFlat may immediately suspend or terminate your account for breach of these Terms. Upon termination, you may request an export of your data within 30 days.

10. Governing Law

These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Warsaw, Poland. If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.
